MEMBERSHIP TERMS & CONDITIONS

These terms and conditions (“Terms and Conditions”) are entered into between SAMSONITE (THAILAND) CO.,LTD. (Corporate office address: 98 Sathorn Square Office Tower 37th floor room no.3705-3706,North Sathorn Road, Silom, Bangrak, Bangkok 10500, Thailand) and you (the “(Member)” or “(you)”).

1. The American Tourister Squad Insider , Squad Star, Squad Ambassador (collectively the “Membership”) are organized by Samsonite Thailand. You are entitled to enjoy certain benefits with the Membership. All Membership benefits as well as any further terms regarding how you can access such benefits as a holder of the Membership or otherwise applicable to such benefits, such further terms being incorporated by reference into these Terms and Conditions. The Membership including its possession of and use by you shall be subject to the Terms and Conditions in effect at the time of use of the Membership by you. Yours use of the Membership is deemed acceptance by you of these Terms and Conditions.
2. To the maximum extent permitted by law, Samsonite Thailand shall have absolute right to revise these Terms and Conditions (including amending any of the Membership’s benefits or how you can access such benefits) at any time at its sole discretion.
3. If you wish to enjoy the benefits under the Membership, you shall provide your contact details, i.e. your telephone number and/or e-Membership issued by Samsonite Thailand from time to time for our verification purpose before checking out.
4. Samsonite Thailand shall have sole discretion to upgrade and/or downgrade your Membership level without further confirmation.
5. The validity period of the Membership is for 2 years and joining (American Tourister Squad Insider) or date of upgrade.
   For American Touirster Squad Insider, the Membership shall be retained with no minimum spending or point threshold but requires at least one purchase every 2 years to remain active, forfeiting any remaining points.
   For American Tourister Squad Star, must maintain at least 15,001 THB within a rolling period, or members may be downgraded to Squad Insider.
   Accounts with no activity for 2 years will be downgraded to Squad Insider status, and any remaining points will be forfeited.
   For American Tourister Squad Ambassador, must stay above 30,001 THB or face a potential downgrade to Squad Star.
   If a member has no activity for 2 years or more, they will be downgraded to the Squad Star tier, and all accumulated points will be forfeited.
   
6. Additionally, depending on the value of the purchase one makes, one will directly be assigned to a tier associated with that value.
7. If a mid-tier member makes a purchase that satisfies the necessary criteria, their tier will be upgraded automatically.
8. Please note that loyalty program points will be credited 7 days after the purchase has been made.

9. The Membership may be cancelled and these Terms and Conditions may be terminated by either: (a) the Member at any time upon giving written notice to Samsonite Thailand; (b) Samsonite Thailand, to the maximum extent permitted by law, at any time (at its sole discretion) upon giving written notice to the Members; or (c) Samsonite Thailand not renewing the Membership at the end of the current period of Membership, without further notice to the Member.
10. All vouchers may only be used on regular priced items in Samsonite stores in Thailand and our online website www.samsonite.th
11. To the maximum extent permitted by law, Samsonite Thailand (including its directors, officers, agents, consultants and associates, along with Samsonite Thailand’s related companies (including affiliate and subsidiary companies)) is not liable to you for any loss, damage or liability (whether direct, consequential, indirect, economic or otherwise) incurred by you in relation to the Membership, including in relation to: (a) your use of the Membership; (b) if the Membership is used by any third party, whether with or without your permissions; (c) your loss of the Membership details (or any liability incurred via your loss of the Membership details, whether before or after you notify us regarding your loss of the Membership details); (d) any revisions to these Terms and Conditions (including revisions to any of the Membership’s benefits); (e) any cancellation of the Membership; or (f) any breach of these Terms and Conditions by you.
12. You acknowledge and agree that any personal data which you provide to Samsonite Thailand in your application for or use of the Membership will be collected, used and stored in accordance with our Privacy Policy available at www.samsonite.th/privacy-policy.html and applicable law.
13. To provide you with Samsonite Thailand’s benefits, newsletters and/or promotional materials in a timely and quality manner, please keep Samsonite Thailand updated whenever you changed your personal information, i.e. email address, correspondence address or contact telephone number, so that Samsonite Thailand can update its records accordingly.
14. The Membership is available for any Samsonite stores (a list of stores can be found at Store Locator in Thailand and our online website www.samsonite.th)
15. In case of any dispute, Samsonite Thailand reserves the right to reasonably interpret these Terms and Conditions if any of them are unclear or equivocal. These Terms and Conditions shall be governed and construed in accordance with the laws of Thailand (including where any issues arise in respect of the use of the Membership in Thailand).

By clicking “Agree”, you understand and agree to the following:

1. SAMSONITE (THAILAND) CO.,LTD.., or Samsonite Group Companies (collectively “Samsonite”), may collect, use, store, transfer and disclose any personal data that you provide under this application for (and, if approved, through my use of) the American Tourister Squad Insider (or Start/ Ambassador if applicable) in strict compliance with Samsonite’s Privacy Policy, available at https://www.samsonite.th/privacy-policy.html/ (“Privacy Policy”);
2. Your personal data held by Samsonite shall be always kept confidential, except that it may be provided on a confidential basis to third parties in accordance with the Privacy Policy (including for Samsonite’s daily operations).
3. Your personal data (name and contact details) may be used by Samsonite to contact you in relation to news, events and promotional offers from Samsonite and its business partners in accordance with the Privacy Policy, if you set “mobile opt-in” and/or “email opt-in” to “Yes”. You can opt-out of receiving such direct marketing communications at any time by setting the “mobile opt-in” and/or “email opt-in” to “No”, or by contacting service@samsonite.com.
4. Your application for (and, if approved, my use of) the Samsonite Classic / Samsonite Black will be governed by the Terms and Conditions set out above.

We want you to be familiar with how we collect, use and disclose Personal Information (as defined below). This Privacy Policy describes our practices in connection with Personal Information that we collect through websites operated by us or our affiliates from which you are accessing this Privacy Policy (the “Websites”), through the software applications made available by us for use on or through computers and mobile devices (the “Apps”), through our social media pages and apps, if any, through HTML-formatted email messages that we send to you that link to this Privacy Policy, as well as through your offline interactions with us where notice is legally required (collectively, including the Websites, Apps, Social Media Pages and offline interactions, the "Services”). By connecting your Services account and your social media account, you authorize us to share information with your social media account provider, and you understand that the use of the information we share will be governed by the social media provider's privacy policy.

We also may use and disclose your Personal Information as we believe to be necessary or appropriate: (a) to comply with applicable law, which may include laws outside your country of residence, to respond to requests from public and government authorities, which may include such authorities outside your country of residence, to cooperate with law enforcement, or for other legal reasons; (b) to enforce our terms and conditions; and (c) to protect our rights, privacy, safety or property, and/or that of our affiliates, you or others.

We may furthermore use, disclose or transfer your information to a third party in the event of any reorganization, merger, sale, joint venture, assignment, transfer or other disposition of all or any portion of our business, assets or stock (including in connection with any bankruptcy or similar proceedings). We may also use and disclose Personal Information collected through the Services in other ways, with your consent.

“Other Information” is any information that does not reveal your specific identity or does not directly relate to an identifiable individual, such as:

• App usage data.
• Information collected through cookies, pixel tags and other technologies.
• Demographic information and other information provided by you that does not reveal your specific identity.
• Information that has been aggregated in a manner that it no longer reveals your specific identity.

If we are required to treat Other Information as Personal Information under applicable law, then we may use and disclose it for the purposes for which we use and disclose Personal Information, as detailed in this Policy.

COLLECTION OF OTHER INFORMATION

We and our service providers may collect Other Information in a variety of ways, including:

We use this information to ensure that the Services function properly.
• If applicable, through your use of the App: When you download and use the App, we and our service providers may track and collect App usage data, such as the date and time the App on your device accesses our servers and what information and files have been downloaded to the App based on your device number.
• Using cookies: Cookies are pieces of information stored directly on the computer that you are using. Cookies allow us to collect information such as browser type, time spent on the Services, pages visited, language preferences, site location, and other anonymous traffic data. We and our service providers use the information for security purposes, to facilitate navigation, to display information more effectively, and to personalize your experience. We also gather statistical information about use of the Services in order to continually improve their design and functionality, understand how they are used and assist us with resolving questions regarding them. We may use and disclose Other Information for any purpose, except where we are required to do otherwise under applicable law. In some instances, we may combine Other Information with Personal Information. If we do, we will treat the combined information as Personal Information as long as it is combined.

This Privacy Policy does not address, and we are not responsible for, the privacy, information or other practices of any third parties, including any third party operating any website or service to which the Services link. The inclusion of a link on the Services does not imply endorsement of the linked site or service by us or by our affiliates.

In addition, we are not responsible for the information collection, use, disclosure or security policies or practices of other organizations, such as Facebook, Apple, Google, Microsoft, RIM or any other app developer, app provider, social media platform provider, operating system provider, wireless service provider or device manufacturer, including with respect to any Personal Information you disclose to other organizations through or in connection with the Apps or our Social Media Pages.

THIRD-PARTY ADVERTISING

We may use third-party advertising companies to serve advertisements regarding goods and services that may be of interest to you when you access and use the Services and other websites or online services, based on information relating to your access to and use of the Services and other websites or online services on any of your devices, as well as on information received from third parties. To do so, these companies may place or recognize a unique cookie on your browser (including through the use of pixel tags). They may also use these technologies, along with information they collect about your online use, to recognize you across the devices you use, such as a mobile phone and a laptop. You have various rights (to the extent these are provided to you by applicable laws) such as to access review, correct, update, suppress/restrict, transfer your data (data portability) to another company, or delete Personal Information that you have previously provided to us. In your request, please make clear what action you would like us to take. For your protection, we may only implement requests with respect to the Personal Information associated with the particular email address that you use to send us your request, and we may need to verify your identity before implementing your request. Please note that we may need to retain certain information for recordkeeping purposes and/or to complete any transactions that you began prior to requesting a change or deletion (e.g., when you make a purchase or enter a promotion, you may not be able to change or delete the Personal Information provided until after the completion of such transaction/purchase or promotion). There may also be residual information that will remain within our databases and other records, which will not be removed for reasons such as exceptions in the applicable law, business purposes or legal reasons.

RETENTION PERIOD

We will retain your Personal Information for the period necessary to fulfill the purposes outlined in this Privacy Policy unless a longer retention period is required or permitted by law.

USE OF SERVICES BY MINORS

The Services are not directed to individuals under the age of twenty (20), and we do not knowingly collect Personal Information from individuals under 20.

We ask that you not send us, and you not disclose, any sensitive Personal Information (e.g., social security numbers, information related to racial or ethnic origin, political opinions, religion or other beliefs, health, biometrics or genetic characteristics, criminal background or trade union membership) on or through the Services or otherwise to us.

We may change this Privacy Policy. The “LAST UPDATED” legend at the top of this Privacy Policy indicates when this Privacy Policy was last revised.
