MEMBER TERMS CONDITIONS

These terms and conditions (“Terms and Conditions”) are entered into between Samsonite (Thailand) Co., Ltd. (“Samsonite Thailand”) (registered address: 98 Sathorn Square Office Tower 37th Floor Room No. 3705-3706, North Sathorn Road, Silom, Bangrak, Bangkok 10500 Thailand) and you (the “Member” or “you”).

1. The Samsonite Loyalty Program Thailand membership (collectively the “Membership”) is organized by Samsonite Thailand. You are entitled to enjoy certain benefits with the Membership. All Membership benefits as well as any further terms regarding how you can access such benefits as a holder of the Membership or otherwise applicable to such benefits, such further terms being incorporated by reference into these Terms and Conditions. The Membership including its possession of and use by you shall be subject to the Terms and Conditions in effect at the time of use of the Membership by you. Yours use of the Membership is deemed acceptance by you of these Terms and Conditions.
2. To the maximum extent permitted by law, Samsonite Thailand shall have absolute right to revise these Terms and Conditions (including amending any of the Membership’s benefits or how you can access such benefits) at any time at its sole discretion.
3. If you wish to enjoy the benefits under the Membership, you shall provide your contact details, i.e. your telephone number and/or e-Membership issued by Samsonite Thailand from time to time for our verification purpose before checking out.
4. Samsonite Thailand shall have sole discretion to upgrade and/or downgrade your Membership level without further confirmation.
5. You will accumulate 1 Samsonite Point (“Point”) in both your Samsonite Lifetime Balance and Samsonite Point Balance for every THB 1 spending at Samsonite stores (directly operated by Samsonite) and Samsonite factory outlet stores in the Kingdom of Thailand (“Thailand”), and the online store at www.samsonite.co.th, upon the expiry of seven (7) calendar days following the date of purchase. [escrow period?] There is no expiry date for accumulated Points. You will be assigned to different Loyalty Levels (namely: Samsonite Familythe Marble, Samsonite the MarbleFamily Navy, Samsonite the MarbleFamily Silver, and Samsonite Family the Marble Black) according to the number of accumulated Points in your Samsonite Lifetime Balance, and you will enjoy benefits in accordance with the table above pursuant to the your Loyalty Level.
6. You will be issued a coupon of THB 100 (“Coupon”) for every 20,000 Points accumulated for your Samsonite Point Balance. For every new purchase, the difference between the number of Points gained for that purchase and the number of Points corresponding to the number of Coupon(s) issued for that purchase will be added to your Samsonite Point Balance. You may redeem your Coupon upon your next purchase in any of the Samsonite retail stores in Thailand and the online store at www.samsonite.co.th. The Coupon may not be refunded or exchanged for cash. The Coupon will expire and be forfeited after 2 years of issuance if it is not redeemed.
7. The Membership may be cancelled and these Terms and Conditions may be terminated by either: (a) the Member at any time upon giving written notice to Samsonite Thailand; or (b) Samsonite Thailand, to the maximum extent permitted by law, at any time (at its sole discretion) upon giving written notice to the Members.
8. All Coupons may only be used on regular priced items in Samsonite stores in Thailand.
9. To the maximum extent permitted by law, Samsonite Thailand (including its directors, officers, agents, consultants and associates, along with Samsonite Thailand’s related companies (including affiliate and subsidiary companies)) is not liable to you for any loss, damage or liability (whether direct, consequential, indirect, economic or otherwise) incurred by you in relation to the Membership, including in relation to: (a) your use of the Membership; (b) if the Membership is used by any third party, whether with or without your permissions; (c) your loss of the Membership details (or any liability incurred via your loss of the Membership details, whether before or after you notify us regarding your loss of the Membership details); (d) any revisions to these Terms and Conditions (including revisions to any of the Membership’s benefits); (e) any cancellation of the Membership; or (f) any breach of these Terms and Conditions by you.
10. You acknowledge and agree that any personal data which you provide to Samsonite Thailand in your application for or use of the Membership will be collected, used and stored in accordance with our Privacy Policy available at https://www.samsonite.co.th/en/privacy-policy.html and applicable law.
11. To provide you with Samsonite Thailand’s benefits, newsletters and/or promotional materials in a timely and quality manner, please keep Samsonite Thailand updated whenever you changed your personal information, i.e. email address, correspondence address or contact telephone number, so that Samsonite Thailand can update its records accordingly.
12. The Membership is available for any Samsonite stores (a list of stores can be found at https://www.samsonite.co.th/en/storesis there a store list?/) in Thailand.
13. In case of any dispute, Samsonite Thailand reserves the right to reasonably interpret these Terms and Conditions if any of them are unclear or equivocal. These Terms and Conditions shall be governed and construed in accordance with the laws of Thailand (including where any issues arise in respect of the use of the Membership in Thailand).
14. These Terms and Conditions are drafted in both Thai and English. In case of discrepancies, the Thai version shall prevail.
